Hawaii Special Court Martial Lawyer

Court Martial Attorney in Hawaii

A Special Court-Martial (SpCM) conviction can result in up to one year in military prison, fines, reductions in rank (for enlisted only), and a Bad Conduct punitive Discharge.  A conviction by this Court is considered a federal conviction and remains on the person's criminal record for life.  Any offense listed in the Uniform Code of Military Justice may be sent to trial by SpCM, however, the more serious crimes are usually heard in a General Court-Martial because of the limitations on punishment at a SpCM.  If the charges are relating to sex crimes or Article 120, UCMJ, a conviction could result in mandatory sex offender registration when released from confinement.  The accused does not have a right to a preliminary Article 32 hearing before a SpCM, but an investigating officer in an Article 32 may recommend that a SpCM is the appropriate forum for the charges.  Facing charges at a SpCM is a very serious matter.

If you have reason to believe that you may be facing charges at a SpCM, you deserve an experienced and aggressive criminal defense attorney.  The possibility of confinement is very real, and military prison is no place to be.  In addition, if you receive a Bad Conduct punitive discharge, finding employment in the future will become imminently more difficult.

If you are facing charges in a SpCM, contact our office right away.  If you already have a JAG defense attorney assigned to your case, you can also hire a civilian defense attorney while keeping your free military lawyer on the case.  This means you essentially, end up with two attorneys working for you for the price of one.  The stakes in a SpCM are high. You deserve an aggressive criminal defense attorney with vast experience handling military cases.
