A Special Court-Martial (SpCM) conviction can result in up to one year in military prison, fines, reductions in rank (for enlisted only), and a Bad Conduct punitive Discharge. A conviction by this Court is considered a federal conviction and remains on the person's criminal record for life. Any offense listed in the Uniform Code of Military Justice may be sent to trial by SpCM, however, the more serious crimes are usually heard in a General Court-Martial because of the limitations on punishment at a SpCM. If the charges are relating to sex crimes or Article 120, UCMJ, a conviction could result in mandatory sex offender registration when released from confinement. The accused does not have a right to a preliminary Article 32 hearing before a SpCM, but an investigating officer in an Article 32 may recommend that a SpCM is the appropriate forum for the charges. Facing charges at a SpCM is a very serious matter.
